1. Definitions

  • Service: The SEO analysis platform and tools provided by DAYWORX LTD.
  • User: Any natural or legal person using the service.
  • Account: A registered user account.

2. Contract formation

By registering or using the service, you agree to these terms. If you act on behalf of a company, you warrant that you have the authority to bind that entity.

3. Scope of service

We provide SEO reports, website analysis, developer tools, and related features. Service availability and features may change. We strive to maintain high availability but do not guarantee uninterrupted access.

4. Account obligations

You must: provide accurate information; keep your credentials secure; use the service lawfully and in accordance with these terms; not attempt to circumvent limits, abuse the system, or use the service for illegal purposes.

5. Subscription and payment

Paid plans are billed according to the plan chosen. You may cancel at any time. Cancellation takes effect at the end of the current billing period. Refunds are handled according to our refund policy and applicable law.

6. Consumer withdrawal rights

If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal from distance contracts. To exercise this right, contact us within 14 days of purchase. If you have started using the service with your consent before the withdrawal period ends, you may be required to pay for the service used.

7. Liability

We are liable for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations or for foreseeable, typical damages. Our liability is limited to the amount paid by you in the 12 months preceding the claim, unless otherwise required by mandatory law.

8. Intellectual property

The service, including its design, content, and software, remains our property or that of our licensors. You retain ownership of data you submit. By using the service, you grant us a license to process your data as necessary to provide the service.

9. Termination

You may delete your account at any time. We may suspend or terminate accounts for breach of these terms or for operational reasons, with reasonable notice where feasible.

10. Governing law and jurisdiction

These terms are governed by Austrian law. Place of jurisdiction for all disputes: Vienna, Austria. Consumers may also bring claims in the court of their domicile under Art. 18 Brussels I Regulation.

11. Online dispute resolution

12. Changes

We may update these terms. Material changes will be communicated via the service or by email. Continued use after changes constitutes acceptance.
